NetMotion Software Website Privacy Policy

Your privacy is very important to us and we are committed to protecting it. Not only do we abide by applicable laws and regulations and follow industry best practices for data security and privacy, we also will never sell or share personal data except as described in this Privacy Policy (this “Policy”).

This Policy explains when and why we collect personal information about people who visit our websites, how we use it, the conditions under which we may disclose it to others and how we keep it secure.

For the purposes of this Policy, “personal information” shall mean any data or information relating to an identified or identifiable natural person, an identifiable natural person is one who can be identified, directly or indirectly, by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity or that natural person.

Who We Are

NetMotion Software, Inc. and its affiliates (“NetMotion”) develop and license software in the areas of mobile performance, mobile analytics and operations intelligence.

How We Collect Personal Information from You

NetMotion may obtain personal information about you by various means.  Most commonly this occurs when you use our websites, including netmotionsoftware.com, and any other websites that link to this Policy.

Also, we may collect information about you when you:

  • Visit us at trade shows and events
  • Attend our webinars
  • Click through our online advertisements
  • Apply for a job
  • Seek technical support for our products and services

We may also collect information about you via various lead generation vendors with the understanding that they have attained the required consent from you to collect your personal information and share that information with us.

Sharing of Your Personal Information

We do not sell or rent your personal information to third parties. We will not share your personal information with third parties for marketing purposes.

We may occasionally employ third parties to act on our behalf to provide marketing support, analysis and public relations. When we employ such companies, they are provided only with the minimal amount of personal information required to deliver their service. We have contracts in place that require them to keep your personal information secure and prohibit them from using that information for any other purpose than to perform the contracted assignments.

In some cases, we may sell product lines or provide services jointly with selected business partners. We may transfer your personal information to a third party as part of a sale of some or all of our business and assets to any third party or as part of any business restructuring or reorganization, or if we are under a duty to disclose or share your personal data in order to comply with any legal obligation or to enforce or apply our terms of use or to protect the rights, property or safety of our customers and business partners. However, we will take steps with the aim to ensuring that your privacy rights continue to be protected.

Data Security and Data Retention

When you give us personal information, we take commercially reasonable efforts to ensure that it is treated securely.

Most of our software products are deployed on customer’s servers and are under customer’s exclusive control. Some of our products are hosted on secured servers from well-known providers such as Amazon Web Services. Please review the Product Privacy Statement for additional information concerning product security and data retention.

Use of Cookies and Tracking Information

Cookies, which are small files stored on your computer, are used by our website and software to improve the user experience; however, no personal information is stored in cookies, only configuration information and user preferences.

Some of our products will collect user tracking information in order to provide certain functions and services to you. Please review the Product Privacy Statement for additional information concerning tracking.

Linked Web Sites

The NetMotion Software web site may include links to the websites of others, however, NetMotion Software is not responsible for the privacy practices or the content of these linked sites.

Your Choices

You have a choice about whether or not you wish to receive information from us. If you do not want to receive marketing communications from us about our products and services then you can select your choices by checking the relevant boxes located on the form for which we’ve collected your information.

We will not contact you for sales or marketing purposes, either by email or phone, unless you have given your prior consent either directly to NetMotion, or to a third-party to which you’ve given consent to share your data. You can change your marketing preferences at any time by contacting us by email at [email protected].

If you choose not to provide personal information, you may still use our web sites anonymously.

NetMotion Software Products Privacy Statement

This Product Privacy Statement (this “Statement”) is a supplement to the Website Privacy Policy located at www.absolute.com.

Products

This Statement applies to the following NetMotion Software products (“NetMotion Products”):

  • NetMotion Mobility®
  • NetMotion Diagnostics®
  • NetMotion Mobile IQ®
  • NetMotion Cloud

Why NetMotion Products Collect Information from You

NetMotion Products collect and store certain information from you in order to perform their functions. In general, the information is used to identify, manage and track the network-related activities of users who use mobile devices for work-related activities. For further details, please see the Data Retention Schedule below regarding each NetMotion Product.

Depending on which NetMotion Products you have installed and how they are configured, the following types of information may be collected:

  • Usernames
  • Email addresses
  • Device names
  • IP addresses
  • Cellular phone numbers
  • IMEI
  • GPS locations

NetMotion Products do not collect or track any sensitive personal data such as racial or ethnic origin, political preferences, sexual orientation, religious or philosophical beliefs, or genetic data.

Collection of Information in NetMotion Products

NetMotion Products, when configured to do so, will collect identifying personal information such as the username, email address and mobile device name. NetMotion Products may also collect networking data, such as IP addresses, cellular phone numbers, IMEI and GPS locations, which can be used to derive a person’s identity. The types and amount of information collected, how it is used and how long it is stored, is configurable by authorized system administrators with access to the servers running the NetMotion Products. Please review the privacy provisions set forth in the applicable NetMotion Product EULA and/or hosted platform Terms of Service for additional product and service specific terms relating to information collected in the course of your use of the NetMotion Products.

How the Information Is Used

The information collected by the NetMotion Products is used to provide customer-requested functions and capabilities of the applicable NetMotion product or service, including monitoring, securing or diagnosing system functions. For example, the NetMotion Mobility® product will store the account names of users who establish a secure, authenticated VPN session so that it can encrypt data traffic, assign settings, apply policies and provide authorized users of the system with the information necessary to determine that the system is functioning properly. For additional information, please review the Data Retention Schedule below for each NetMotion Product.

Personal data associated with product functions and capabilities is only available to users authorized to access the systems. Personal data is never sent to or collected by NetMotion Software, except at the request of the user.

Sharing of Information

NetMotion Software does not sell or share any information from the NetMotion Products with third parties. NetMotion Products do not share data or information, unless they have been specifically configured to do so by a system administrator. Specifically, persons who have been granted administrative access to the management UI or the underlying computing instance in which a NetMotion server is running have access to all the data generated by the system. Therefore, customers should take care to follow NetMotion’s deployment guidelines and to use industry best practices to restrict access to the computing instances and software systems.

Data Security and Data Retention

Data security and data retention depend on how the NetMotion Products are implemented. Most of our products are deployed in the customer’s data center under the exclusive control and supervision of the customer. Customers are responsible for controlling the access to and security of the NetMotion Products installed on their premises.

We also provide hosted services (NetMotion Cloud) on a subscription basis. Hosted services are implemented using well-known providers such as Microsoft Azure or Amazon Web Services. For NetMotion Cloud hosted systems, our administrative activities are limited to ensuring the system is functioning properly and providing technical support to personnel authorized by a customer to receive technical support. NetMotion Cloud administrators do not access any of the hosted systems except as required to do so to perform system maintenance or in response to a customer support case.

NetMotion Products will retain your information in accordance with product functionality and user configuration. NetMotion Products have varying data retention schedules, which may last from a few hours up to 180 days, depending on the type of data and the system configuration. Additional information is provided in the Data Retention Schedules below for each NetMotion Product.

Use of Tracking Information

NetMotion Products, when properly installed and configured, will collect identifying personal information such as user name, email address and mobile device name. NetMotion Products may also collect networking data, such as IP addresses, cellular phone numbers, IMEI and GPS locations, which can be used to derive a person’s identity. The types and amount of information collected, how it is used and how long it is stored, is configurable by authorized system administrators with access to the servers running the NetMotion Products.

Your Choices

By installing, accessing or using NetMotion Products, you are requesting and consenting to the collection and use of certain personal information by the NetMotion Products. The administrative configuration of the NetMotion Products will dictate the type and amount of information collected by the NetMotion Products.

The information collected, used and stored by NetMotion Products is only available to authorized users and administrators of the NetMotion Products. Any personal data collected by NetMotion Products is retained only for the configured period. It is up to the customer to decide how much data to collect and how long to retain the data.

This Privacy Statement is effective as of November 10, 2020. NetMotion may amend or update this policy at any time.

Data Retention Schedules

NetMotion Mobility®

What data is collected and what is it used for?
To provide its security and optimization and management functions, NetMotion Mobility® collects data on an organization’s users, devices, applications and network activities. The data is displayed in the Mobility console, written to Mobility system log files and stored in the Analytics module database.

Default Retention Schedules
The following system components process personal information and are accessible by anyone with physical or logical access to the Mobility server’s hardware or operating system instance, and to anyone authorized to access the information in the Mobility console.

If the Analytics module has been configured to publish data, the data will be stored by the receiving host according to its retention schedule. No data is published by default.

NetMotion Diagnostics®

What data is collected and what is it used for?
NetMotion Diagnostics® collects and stores device, radio, network, location and performance data on behalf of organizations licensed to use the software. This information is used for tracking and troubleshooting device and network usage, and problems that have an impact on network performance, device performance or user productivity. Stored data can correlate network and location information to a specific user.

The data is stored in the Diagnostics database, displayed in the Diagnostics console, written to system log files and may also be published to other systems, including Mobile IQ. Data elements can also be sent to other systems using the data export or publishing features.

NetMotion licenses a hosted version of Diagnostics that runs in NetMotion Cloud. Each customer’s system resides in its own private host instance—the system is not multi-tenanted. Host server administration, version-to-version server upgrades, and server operating system upgrades and patches are managed by NetMotion Cloud staff, who do not access customer data stored in cloud-hosted versions of Diagnostics.

NetMotion Mobile IQ®

What data is collected and what is used for?
NetMotion Mobile IQ® aggregates and reports on data exported by Diagnostics and Mobility. On behalf of licensed organizations, Mobile IQ integrates and reports on these data elements, reporting on various aspects of performance, threat defense, costs and inventory, including device location, user activity and application data flows.

The data received by Mobile IQ is under the control of the Mobile IQ administrator and is stored only on the Mobile IQ server. Mobile IQ administrators are responsible for system access and data security.

NetMotion licenses a hosted version of Mobile IQ that runs in the NetMotion Cloud. Server administration, application, and operating system upgrades are managed by NetMotion staff. NetMotion staff do not access customer data stored in cloud-hosted versions of Mobile IQ.

Default Retention Schedules
The following system components process personal information and are accessible by anyone with physical or logical access to the Mobile IQ server’s hardware or operating system instance, and to anyone authorized to access the information in the Mobile IQ console.
